Hey ladies,
As far as I can tell, the 11 am time looks good right now.
I hope you both understand I am simply learning along the way what the actual laws are regarding how such notices are to be properly processed.
Sometimes I feel I am in a very weird zone. So when that happens, I simply go back to the actual rules & laws we all agree to live by for clarity.
I think you both are consumate professionals & are a great team.
This is simply my analysis of this particular case.
I love everyone involved & my heart does not discriminate. My head is working out how to protect all involved parties & also the ultimate goal of helping disabled people who live here, me included, get on with LIFE & healthier ways.
I wish it was more easily accomplished, but then again, our experiences are what teach us.
As Nicole has reminded me several times, the rules are for all, as are the laws & rules of civil process in resolving conflict for all.
I have been inaccurate before, but I do my best to provide factual information & truthful help. Doing the best I can.
Having written what I did before, I also will let you know I feel ambivalent about who I allow in & out of my space, & this is subject to change. It is part of my own healing process. So I do not want to leave you both with the impression I am insisting upon Ken visiting, just that, as far as I know, the steps taken thus far are legally not entirely made.
At the social level, one would hope that when someone tells you to take off & deal with yourself & your own problems, they respect this. Sometimes they don't though, so I AM grateful for the assist in helping me set such boundaries these past few days & weeks.
The only thing constant in life is change. Hopefully it is all for the better, & more harmonious relations with friends & neighbors all the way around.

This is a letter to follow up on a conversation I had with you, Russ,
yesterday concerning quality of care issues & doctors at Central Vermont
Hospital. First of all, I thank you for your prompt & compassionate,
intelligent responses to the cases & issues I presented to you
yesterday. Dr. Williams, who cares for Everett Larrabee, called me
promptly & made note of my concerns & observations about Everett selling
his prescription narcotics Dr. Williams prescribes post MVA in late
June. I am assured that street source of drugs is being dried up as you
read this.
However his case is not an isolated one.
Let me present the next case I was concerned about, a patient who lives
in Berlin. As always, this information is HIPPA protected, & I myself
am currently a full time patient, & community member. Not an active
registered nurse with any organization at this point in time.
Wayne Gray or Grey of Berlin is an adult man who has, to my knowledge
been receiving what I would consider a huge amount of prescription
opiates; percocets in particular, which he too has been making money
with by selling on this grey market I spoke to you about yesterday. I
was concerned about him & his family too, as this has been going on for
over a year now.
Anyway, he too, crushes & snorts these pills, as do many in the
Barre/Berlin/Montpelier region. He also makes a supplementary beer
buying budget to add to his prescription mix by selling the
overprescribed amounts to friends & neighbors who buy them as an
unofficial "pharmacist" in the region.
On this past Sunday,August 21, 2005, Wayne blacked out & wrecked his
car, landing him in the CVH ER. This report was given by a close
friend/ sometimes boarder of Wayne's who I ran into in the lobby today.
He WAS tested for drugs at that point in time. According to this
source, who is reliable from my experience, they found only Klonopin in
his blood. He was asked point blank about where the other pain meds
were & to produce them. He had been given a new prescription for them
only three days prior to the car accident. He could not because by the
knowing source, they had all been sold.
Who is his physician? Why is this practitioner so blind? For so long?
Hmmmm....
NOW, on to my personal case. As you both know, (Michael was contacted
before about my complex case through Legal Aid services, he is a health
care ombudsman), I have been extremely frustrated in the journey to
personal recovery from a near fatal encounter with an estranged husband.
I have been helped MAINLY by the Department of PATH through a General
Assistance grant which is renewed month by month as it is the emergency
provision program. I am alone. I now live in section 8 housing,
through the aid & support & advocacy of Battered Women's services,
Barre. I had MD notes which are required to continue receiving a meager
56.00 a month in cash assistance grant to supplement basic health
insurance (no dental), & food stamps. PATH also pays for my utility
bill. My lights. Heat is included in the rental agreement which I pay
zero per month for.
TODAY I went to see a psychiatrist for the FIRST time since this journey
began after the shooting in October 2003. Because it was the FIRST time
one was appropriately found & I was referred to her, through Dr. Atkins.
However, prior to this, I was being cared for, if you can call it that,
by a Dr. Patrick Keith of Stowe Family Practice in Stowe. The real
economic & practical situation was that I was unable to see him due to
the distance from my home. I have no licenses now, they all expired, &
no operating vehicle, with no funds for gas or transportation to see
him.
This has all been explained to Dr. Debbie Atkinson. Who I FINALLY got
as a family physician last February. I have visited her several times
now, & signed authorizations, & sent numerous FAXES from home & the
employment office to request each & every piece of my medical record
from Dr. Keith.
Deb Atkinson has told me the records she received are sparse & that they
do not justify writing a further out of work note which is NEEDED to
maintain the current low level, the subsistent level of support PATH GA
grants provide. That this is the ONLY form of support I rely upon while
I work at getting back to paid employment, & pending the SSI claim I
also have opened after the proper time frame to do so had passed. Last
November of 2004.
I signed an agreement with PATH the day I opened the SSI claim that I
would REPAY the 56.00 per month grant once I recieved the SSI benefit
which I have worked over 27 years in professional nursing to gain. It
is my benefit, I am not a malingerer, I am not trying to milk the system
& I feel like when I talk to Deb, she simply does not believe the bare &
starkly awful facts of the situation!
Today I met with her & Dr.Eyler, a psychiatrist who affiliates with her
practice to work on issues such as these.
I have HAD therapy. I have SIGNED authorizations. I am WILLING to go
back to work, but even though I have applied faithfully to a minimum of
3 jobs per week I have yet to be gainfully employed. No lack of
diligence or motivation. It simply has not happened yet.
In the meantime, I have hired a lawyer, Lamb et al out of Burlington to
represent me at the third appeal level of the SSI claim. Again. I
signed authorizations to release ALL records of care for this claim &
advocacy.
What I am miffed about is Deb's attitude; "it is not our responsibility
to get the records" is all she has said repeatedly to me.
WELL, I SIGNED the releases for HER STAFF to get them!
It seems to me, if I were working WITH her as a paid nurse, I would be
the one to GET them. ALL of them. There are copies of news reports,
extensive notes I drafted myself in that record. She has been told
this.
If a PATIENT who presents as CURRENTLY on GA & STILL not fully recovered
tells a doctor, who is gainfully employed full time caring for patients
that this is so, why does she essentially blame the victim?
Or not give me more concrete directives? Not simply "it is not our
responsibility"???? Then, if I SIGNED for these releases WHOSE
RESPONSIBILITY IS IT? The man in the moon? A good nurse worth her salt
would be doing the leg work. Again, one that is EMPLOYED to collaborate
with the physician that nurse works with. That is what I used to do. I
certainly would not turn around & tell someone it was their fault & they
should do it when it is her review of the record, & determination that
the record is inadequate that is her judgment!!!
I am frankly disgusted. I gave my all until I was shot. I expect no
less from my colleagues. Your doctors are asleep, all of them I have
encouintered. Or so comfortable in their own first world comfort that
they have lost touch with Maslow's heirarchy of need. You do not
stabilize a person in the community, only to pull that support away from
them, because OFFICE STAFF YOU oversee do not do their jobs!!!
NOW I want Dr. Atkinson to get on the phone PERSONALLY to Dr. Patrick
Keith, after my visit & TELL him I, Monica King, want EACH PIECE OF MY
RECORD or else I will send a sheriff via a court order to seize the
ENTIRE record from him. And have him disciplined according to the full
extent of the law. And if she does not want to do that, I will amass a
group of these lazy-assed docs together at CVH & get a class action suit
going.
Can you tell I am PISSED!!! You bet I am.

Hello Monica. I wasn't insulted or affronted by any of our interactions,
it's just that I can't help you in my current job. Legal Aid helps with a
limited number of landlord-tenant situations where there is a good chance of
the person being able to remain in the housing. All other landlord-tenant
cases go to Law Line, which is where you were referred when you originally
called. I don't think your case fits the Legal Aid requirements because you
are not still in that housing. Also, I'm in the Burlington Legal Aid
office, which only covers Chittenden and Franklin counties. I think you
live in the region of a different Legal Aid office (Montpelier?). Law Line
is state-wide. If you want to doublecheck whether there's a chance Legal
Aid can help you, you should call the Montpelier Legal Aid office
(1-800-789-4195) or St. Johnsbury Legal Aid office (1-800-769-6728),
whichever is closer to where you live. Tell them what you are looking for
help with and they will either take your case or refer you to Law Line for
advice. Good luck!

Thanks for the update on your moves.
I am somewhat confused though. Isn't Legal Aid a place where folks with
landlord/tenant disputes can seek help?
I recall going in to the Voc Rehab office this week & seeing a poster about
this organization, listing this type of conflict, along with issues of the
disabled & or discrimination issues being handled there. Am I incorrect
about this?
From my perspective, it would be the most help to have you help me some
more, since you were the first real assistance I gained within the legal
field of practitioners.
I have absorbed much of your teaching, & the appeal this time was easy to
file. I am happy to report that, when I finally had a "day in court", after
all this time & coaching, I felt OK. I felt comfortable.
It became clear to me how to focus my arguments in a legal way more
effectively, & how to appeal on legal grounds what I would like the court to
address.
It is the area of law which fascinates me. My own ability to master strong
emotional responses to what I see as rank injustices has grown with the
passage of time & retelling over & over, out of necessity, the story that at
first was overwhelming to tell or analyze with any degree of objectivity.
Now I see where I would like to emphasize legal argument; the competing
interpretations of relevant laws in fair housing, protections for the
disabled, discrimination, & disproportionate power struggles which underly
the David & Goliath encounters a court room battle shapes up to be when it
is the rich against the poor.
I am forwarding my Notice of Appeal for you to see.
I am simply asking you if in your new job, you can still help. I am a
faithful student of yours. My disappointments in the past which I expressed
to you as a person representing law in Vermont, I hope you do not take

Hello Guen!
Hope your summer has been full & satisfying this year. I have been walking
through another year iof consolidation with the Aftermath of my attack here
at Highgate in Barre, & finally did get a hearing for my Counterclaim in
Chelsea in Orange County Superior court.
I went before a woman judge, & she did conduct a relatively benign hearing,
however at the end found it just to award the plaintiff with back rent for
the time I was not physically in the home, pending the result of these legal
processes.
I continue to appeal this. There was a blatant disregard for the other laws
I had asked her to take into consideration both protecting people on
disability & victims of violent crime. Also the violations of public health
laws & housing codes currently in effect.
So, now that I have learned something of the appeals process, & this was a
Final order, I did get the Notice of Appeal drafted & sent. Noting the
problem of not having funds to gain the transcripts of tapes needed to
present it to the supreme court justices. Yesterday I received the official
transcript of the proceedings throught the court clerk, & a form to update
to proceed in forma pauperis, although I had signed & notarized one already
the day or two after the Final hearing in the Washingotn county court house.
Which was sent to the Orange county clerks via USPS.
Anyhow, today I will fill out the updated form which is unchanged.
Emily, the Superior Court clerk, & Darleen in the Orange County court have
both been extremely helpful & supportive. I am so grateful to them both.
Emily urged me to get in touch with you to prepare for the next steps. So
here I am again, the email maven, moving & stirring up change, hopefully for
the better!

I am also copying an excerpt of a letter I wrote my own daughter, Syd,
who is just starting her first professional job as a social studies
teacher in Chelsea this year after completing a Masters at UVM. She
will be working with middle school aged children:
"I plan to be in Vermont until most likely at least the end of October,
if not later. As I mentioned before, there are no crises or urgent
needs to leave, simply a larger vision of what I would like to
accomplish with gardening & low income folks, & the disabled. You
should see the gardens now!
They are the best ones so far. My zuchini plants look like they came
from the Flinstones!!! The vigor of the plants, & the flavor of the
vegetables is amazing. I attribute this in part, actually mainly to the
flower essences we used throughout the planting, & growing season. The
kids program coordinator has taught the children all about using flower
petals in water, & when we had our appreciation dinner for all the
volunteers & donors of various items & services, we had a jug on the
table to drink as well.
The young Community Services coordinator, Colleen Purcell who reminds me
so much of you, made a beautiful slide presentation with music to show
all the various phases & activities of the community garden project,
along with many photos of gatherings we had monthly at the community
center. Lots of pics of smiling children, their parents, & staff! It
really is a lovely location, despite the issues with addictions &
vandalism, & she certainly helped alot with the healing process on all
fronts.
I learned a great deal too. By focusing on community development &
increasing the number of intergenerational events in a month offering
free meals, it helped strengthen those who are affected the most, the
elderly disabled, & babes, young moms & children.
Today I have a rainy day & am playing with craft items. I hope to set
up a table at the Barre Farmers Market this week to sell some of the
produce & some wild gathered herbs with little educational cards to
teach more about native plant medicine to the locals.
My larger vision is to create a kind of condo share arrangement between
Highgate & Eagle's Point, a sister apartment complex in Brunswick,
Georgia, where the climate would allow for an extended growing season.
With gardening being the unifying theme, I am hoping there can be an
exchange of places set up for those who would like to travel & see
another part of the country while learning about different growing zones
& the types of plants that can be cultivated in each area.
I am also hoping to encourage Central Vermont Hospital to start a garden
for the residents, patients & staff of CVH, as it is so healing on so
many levels, & this is a model I saw working well in New Zealand when
you were conceived, & later in South Africa in the poorest parts of the
black townships recovering from years of Apartheid regimes.
We are what we eat!
Still acting locally & thinking globally, blooming where I am planted."
Russ, I intend to use my own experiences with being attacked by a gunman
to help those young kids returning from Iraq with ballistic injuries.
There is nothing like your own real initiation to create empathy!
I am so grateful I had the background in nursing & psych to rely upon as
my mind went through the stages of healing that look & feel familiar to
me after October 2003. I really did not have the capacity to return to
reading the professional literature relating to trauma recovery much
before the sentencing phase of the trial for his criminal acts was over,
& during that time frame, I relied heavily upon the counsel of the
Battered Women's support groups & counselors, the individual help &
support of a counselor at Washington County Mental Health, & later, the
Trauma LINCS group Barbara Neilson & others at Washington County Mental
health created several years ago.
In my time in Barre however, I also have seen a great need for similar
groups to be available to hurting men too. Women may be the
overwhelming majority of people who suffer from domestic violence, but
men are also abused in domestic situations, & certainly could benefit
from learning the mindfulness techniques & DBT type of coaching which is
integrated in the Trauma LINCS model of group help.
To give you an idea of the fall-out we as a State, community & nation
face if we do not get proactive about meeting the real needs of
returning national guardsmen & soldiers from Iraq, more fall-out is
inevitable in terms of drug addictions, alcoholism, & suicide. As you
may know anyway, the adult white male population in civilian life
suffers from suicide as a #1 cause of deaths in the 30 & up age range.
Suicide! They commit is slowly with drugs & alcohol, or swiftly in a
provoked violent encounter. Or simply blow their brains out. If we can
be more effective in outreach, intervention, & prevention, our lives
will all be that much more peaceable.

I think starting a garden at CVH using folks like me who are struggling
to reground themselves could be a very healing project. Colleen has
amassed a large group of donors & volunteers who I am sure could be
tapped. We could go at it as Colleen & I did for the Highgate project
starting now with a site selection, possibly turning some earth during
the fall & adding supplements so it could be ready for spring plantings.
Fruit bushes such as rasberries & blueberries can be planted in the
fall, as can winter crops. If there was a small simple greenhouse set-up,
lettuce, spinach & other quick growing veggies can be succession
planted through the winter.
There is a wonderful synergy which develops as one gardens & stays close
to plants, watching how they sprout, grow, develop & mature. I learn
many daily lessons from my plant friends in our gardens here; how
transplanting affects some species, spaces needed for healthy
development, how climate affects them etc., etc. They do not make noisy
companions either!
Just some more food for thought.
Please let me know if I can be of any assistance to you in any way
concerning such innovations & expansions on all the GOOD CVH does for
the community! I know the problems I have encountered & written of
before are not necessarily deliberate or intended to harm or abuse.
Perhaps simply symptoms of professionals bombarded with crises day in &
out, weary of the smell of sickness, disease & death. Gardens make
welcoming, quiet & close retreats for minutes or hours for those who
need a little time out from a rainbow of code alerts & OSHA regulations.

returning national guardsmen & soldiers from Iraq, more fall-out is
inevitable in terms of drug addictions, alcoholism, & suicide. As you
may know anyway, the adult white male population in civilian life
suffers from suicide as a #1 cause of deaths in the 30 & up age range.
Suicide! They commit is slowly with drugs & alcohol, or swiftly in a
provoked violent encounter. Or simply blow their brains out. If we can
be more effective in outreach, intervention, & prevention, our lives
will all be that much more peaceable.

I think starting a garden at CVH using folks like me who are struggling
to reground themselves could be a very healing project. Colleen has
amassed a large group of donors & volunteers who I am sure could be
tapped. We could go at it as Colleen & I did for the Highgate project
starting now with a site selection, possibly turning some earth during
the fall & adding supplements so it could be ready for spring plantings.
Fruit bushes such as rasberries & blueberries can be planted in the
fall, as can winter crops. If there was a small simple greenhouse set-up,
lettuce, spinach & other quick growing veggies can be succession
planted through the winter.
There is a wonderful synergy which develops as one gardens & stays close
to plants, watching how they sprout, grow, develop & mature. I learn
many daily lessons from my plant friends in our gardens here; how
transplanting affects some species, spaces needed for healthy
development, how climate affects them etc., etc. They do not make noisy
companions either!
Just some more food for thought.
Please let me know if I can be of any assistance to you in any way
concerning such innovations & expansions on all the GOOD CVH does for
the community! I know the problems I have encountered & written of
before are not necessarily deliberate or intended to harm or abuse.
Perhaps simply symptoms of professionals bombarded with crises day in &
out, weary of the smell of sickness, disease & death. Gardens make
welcoming, quiet & close retreats for minutes or hours for those who
need a little time out from a rainbow of code alerts & OSHA regulations.

hurricane Katrina & would like to share with you some immediate
resources for all the relief workers to use as this evacuation
& disaster response progresses.

Thank you all for the fliers coming with the newsletter.
The above webpage has numerous notes from folks whose prayers were answered.
Also, the bees seem to have calmed down. I guess I prefer to wait on using
any spray for them. They are slow & not hurting anybody.
Arthur enlisted the aid of his priest to help bring some supplies to the
Montpelier gathering. I saw in the news that Vermont collected 13
truckloads of supplies. It is gratifying to know we all did somehow
contribute to the effort.
I myself have had trouble sleeping seeing the images of the desperation.
So, ways to help, small or great help relieve some of the feelings of
helplessness.
