I have talked to the claims rep and Nationwide is not going to budge on

this. From all the information from the police report and their

investigation they have determined you were at fault. I am sorry about

this but that is there final answer.

Hi Chris!



Here is the case info that Jim wrote to you about:



I am insured by you all. The insurance was on a Toyota Tacoma truck

registration # BHP524, year 1998.



Theresa Montevani is the adjuster. Her number is:

1-800-700-9203 ext 2484



I was hit by a hit & run driver on the evening of September 22, 2006.

On Maple Ave. a couple hundred yards from the deli there. Its was about

6:40 on a Friday evenng. In Barre City.



The driver & his passengers left the scene & it turned out, had stolen the

vehicle they used to hit me.



This is recorded in the Police report.



I was in the process of backing into a driveway, which is not an illegal

act. I was moving slowly, exercising reasonable care & caution according

to our Vermont Motor Vehicle standards while doing so. I looked over my

left shoulder first to see if anyone was coming down the road on the same

side ( the deli side) of the street. There was no one.



I then looked to my right over my shoulder to begin making the turn,

backing in slowly, when BAM!!!



I was hit on the left front side of the vehicle just above the tire,

knocking me & the whole vehicle into & up onto the side of the road.



The drivers continued to drive & tried to leave, but their vehicle was not

moving much further. The airbags were released in their vehicle, the

windshield was smashed, & three youths were seen by neighbors who responded

when they heard the crash, one of them bleeding. They all scattered & ran

through neighbors yards to escape.



The stolen vehicle was registered & properly insured by the owner. But is

was STOLEN.



I received a letter of summary from Theresa saying that they would NOT

grant the claim because in their opinion, it was my fault.

Their reasoning was that, had I decided to wait to reverse direction by

going down the road a bit further & then signalling to take a left, the

accident would never occurred.



This does not stand up to the test of logic.



It makes an erroneous assumption.



It is not her job to PREDICT what MIGHT have happened, it is her job to

INSURE ME, the consumer of her product.



She can not with any certainty at all SAY whether or not kids doing illegal

things & who left a scene, who HAVE been found to have committed crimes

would NOT have if I had been sitting in the road waitng with a left turn

signal to make a turn onto a left sided street waiting for other traffic to

flow past so my chance to turn was clear. Since that was NOT what

happened, it is MOOT.



NOW I am STILL without a vehicle, never got a loaner car while I was

waiting for repairs that were waiting to be made, when authorized by the

insurance folks. The vehicle is at Poulin in Barre where I originally

bought it.



I have been using GMTA. That is now almost 4 months ago. And I paid

600.00 in advance for this policy which is due to be renewed on the 27th.



Would YOU renew? I highly doubt it, if that was the outcome of your

money's investment.
